Paul, we have to deal with the issue of Progress Publishers a great deal on
the MIA, and here is how we see it.
So far as we know, Progress Publishers in the former USSR has
transmogrified into a very low-grade outfit that doesn't care a fig for its
old Marxist works. Also, since before 1991, Progress was the official
publishing house of the Soviet state, under international copyright law,
what a state publishes is by definition in the public domain. Now, I
understand that there have been counter claims coming from other former
state publishers, with for example, Che Guevara's daughter claiming and
enforcing her rights in her father's writings published by a state which
militantly opposed intellectual property, but so far as I know, PP cannot
make any claim on material publishes during the Soviet era. The moral
rights of living authors and the claims of their family estates is
something else. I am not a lawyer and I don't know if these claims have
been challenged, but I suspect that no-one on this list or the MIA would
stand against the claims of the authors or their families.

But as well, Progress Publishers worked in collaboration with International
Publishers in the USA and Lawrence and Wishart in the UK and many other
such companies in capitalist countries around the world, companies which
were in the private domain then and remain so, and insofar as they could
prove that they were the creators of any content in works published in
collaboration with Progress, they could claim intellectual property. In
this context, International Publishers, the publishing arms of the
Communist Party of the USA, claims intellectual property in the Marx-Engels
Collected Works, jointly with L&W.

The whole area is very messy and so far as I know untested in court (thank
goodness). If people want to retain these works in the public domain or
secure the rights of the families, then making new translations and adding
editorial content and re-issuing them via a big bourgeois publisher in the
US or Europe would be a good move. On the other hand, only the authors, if
they are alive, or the moral claims of their families if they are not,
stand in the way of distributing USSR-era material not owned by L&W or IP.
