I should have included the following that clarifies what is meant by
"program" and "activity" in the basic Title IX statute:.

20 U.S.C. Section 1687:

For purposes of this chapter, the term "program or activity" and "program"
mean all the operations of:

(2)(A) a college, university, or other postsecondary institution, or a
public system of higher education; or

(b) a local educational agency (as defined in section 8801 of this title),
system of vocational education, or other school system;

I suppose one could haggle about what the "criminal code" is but breaking a
law is widely recognized as a crime, whether it is in the civil, family,
contractual, criminal, or other section of state or federal laws.
